Dr. Phil’s Disappearing Rape Tweet

Outrage after TV therapist asks Twitter followers if date rape is justified

First you see it, now you don’t. Dr. Phil—or whoever manages the TV therapist’s Twitter account—quickly deleted a controversial tweet this week, which said “If a girl is drunk, is it okay to have sex with her? Reply yes or no to @drphil #teenaccused.”

The tweet was deleted after outrage Tuesday over what appeared to be a trivialization of date rape. Responses ranged from serious attacks on Dr. Phil’s credibility to jokes at his expense. Comedians and feminist bloggers had a field day. Comedian Rob Delaney tweeted:

Carmen Rios, an anti-rape activist, started a change.org petition demanding that the TV self-help guru apologize. “Sexual contact without verbal, sober, conscious consent is rape,” she said in her petition, “and yet, this respected television doctor is questioning whether sex with a person who is incapacitated is rape at all.”

Dr. Phil’s team attempted to explain that the tweet was intended to generate discussion about date rape, not provide room for justification. Stacey Luchs, a spokeswoman for Dr. Phil, said in an email to CBC News that “This tweet was intended to evoke discussion leading into a very serious show topic based upon a recent news story, hence the #teensaccused label.”

Luchs said the tweet was linked to an upcoming show featuring the mother of Rehtaeh Parsons, the Nova Scotia teen who killed herself in April after a two-year ordeal involving date rape and cyber-bullying.

what I dont understand is why people are knocking dr. phil..he is  trying to help..the people in this world that rape is wrong..and he gets blasted.What if it was your child.I wish Dr phil would talk to me,,cause I have things to say about how I got treated in the justice system....we all should be happy aabout this parsons case

I question the motivation behind Dr. Phil's question. It is blatantly obvious that it is illegal to have sex with someone who is drunk. That is the law. And coming from Dr. Phil who has addressed this issue many times it makes no sense that he says he was just trying to spark a discussion. 

In addition Dr. Phil himself, was accused of having inappropriate sexual contact with a 19 year old girl when he was a practicing therapist. He also was charged with  having this female work for him. His license was removed and he never attempted to have it restored. They did not have enough evidence against him for his sexual misconduct but they did prove that he had a patient working for him, which crossed boundaries. 


In addition he was charged with scamming investors in a real estate fraud. He left town in the middle of the night and his real estate clients were left hanging.

His first wife said he was controlling and abusive. And that he cheated on her many times. When she approached him about his infidelity he did not deny it. 


Knowing some of his background I don't think he asked that question to spark a discussion. Somewhere in his mind he really does not believe that it is wrong to have sex with a woman who is drunk.

That is not true at all, passed out drunk sure, but .09 drunk?  No way that is just most couples after splitting a bottle of wine.

I'm no Dr. Phil fan -- I find him to be a tad pompous and with a tendency to claim expertise in areas outside of his formal training.

However, this seems to have been a case of his show staff "chumming the waters" of social media in search of misogynistic sharks who would be willing to come on his show and defend the 'act of raping an inebriated woman' ... so that the good Doctor could then proceed to skewer them in front of a television audience.

@BeeksieCrackhat People are not stupid. Dr. Phil was stupid to ask that question and that is why he removed the tweet. What is incredibly clear is that you don't have sex with a female that is drunk. You don't have sex with a female under 18. You don't have sex with your students if your a teacher. You don't have sex with a male under 18. You don't have sex with your patients. All of this is common knowledge to everyone. Dr. Phil is the one that is stupid or outright insensitive or both.

@BeeksieCrackhat What is "incredibly clear" is that Dr. Phil and everyone else already knows the answer to that question. If he posed this question twenty five years ago, I would believe he did it to generate a discussion. It is like asking a stupid insensitive question like is it ok to engage in sex with a girl sixteen or is it statutory rape?

Many guys don't get it, as a number of recent studies and polls have shown. So how do you educate them? Dr. Phil chose the Socratic Method.

What's silly is the borderline concrete-thinkers that won't even allow the conversation.

@MsJennyAllen @not-a-rap-fan All guys get it. Whether or not they choose to respect the LAW or not is the question. And that is why this question is stupid and silly. If anyone does not know the answer go up to a cop and ask him or her and they will give you the answer. It is not a difficult concept to get, and the question has been asked and answered a million times before.

People are after Dr Phil and his staff for this comment.  How about Sirrus radio host Laura Schlesinger (sp) who says any female who goes to a party where drinking might be or is occurring is asking for whatever happens including having non-consensual sex.  She has said on her show that she has absolutely no sympathy for women who are raped and especially when they drink.  

She also likes to say she once was a feminist but she’s not any more because feminists are out to do men in.  

My take on her is that ANYTHING a man does is good while women should do whatever it is–including allowing their “man” to beat them–because they need to be a girlfriend.  

Unless one has Sirrus, one probably won’t hear her spew her anti-woman trash.

Well, when freshmen girls go right for the frat parties and get drunk, they will be raped, not much doubt about it.

Doesn't mean it right but if they know about it and still go then they made a bad choice.

The problem is... no matter men or women, people don't know what they are doing when they are drunk. A drunk girl might say yes to sex but totally forgot about it when she is sober...and claims she was raped. So both guys and girls, don't get drunk!! And never believe a drunk person. Of course, never rape anyone!

What is wrong with this question? I do not see Dr. Phil saying it is OK . I see a  very pertinent question. What is the opinion of the public on this issue? Of course,we all know by law, sex without consent is rape. The issue raised here is that if a partner is drunk, then consent is never given because of impairment? What if both parties have been drinking? At what level of consumption is "Drunk"?  Some responders seem to be saying that consent to sex is not valid if alcohol or perhaps even drugs are involved? Have a glass of Champagne while seducing your date and be later be accused of "Date Rape" ?  Dr. Phil is just asking a question. We need free discussion to understand and solve social issues like this. This question should not be taboo.

@DaveClark1 What's wrong with this question? I love that men put on their defense attorney hat and mince words when it comes to the issue of rape. Put it into same gender categories- men get raped. Would you be ok if you were having champagne with a man and he had sex with you because you couldn't give consent. Rape happens to both genders. 

I know this may be hard for some men to wrap their heads around- but there are real men out there who wouldn't even consider sleeping with a woman while she can't give consent.  Those men are real men.

Cowardly men try to have sex with a woman when she can't give consent. Those men are rapists and they belong in jail. 

It's a black or white issue no matter how society tries to spin it in order to justify bad behavior.

If a man raped another man while that man was drunk, he would probably try to kill him when he got sober. Sarah310 I like the way you ask if a man were to rape another man, instead of if a woman tried to have sex with a man who was drunk. Excellent comment.

But the man who got raped would not have been flirting with the other man, grinding on him, willingly going up to his room and getting undressed and having sex with him...  That is the kind of "rape" that is really not rape.

RAPE is as black and white as you can get. Where are the shades of gray? Nobody said anything about men dating women who they find in clubs, bars,etc. This is about having sex with a woman who is drunk, that was the question. This is about if you get drunk and can't give consent and the man decides I will have sex with Jenny Allen regardless if she is drunk or not.

I'm glad to know there are women out there who think women who speak out about rape are "flat out idiots" and "borderline lunatic". Since you went you the personal route and got rude I'll do the same courtesy to you. 

I'm willing to bet you schedule sex with your husband or partner. You have perfect kids, you have headshot with pearls so you're probably an attorney or accountant. You got good grades in college and you judged women who went to bars. Rape and the aftermath of it either affected you one of two ways: you either have had no contact ever with a rape victim or you are are a victim of sexual abuse or a defense attorney. Whatever the case is, it takes a lot of hate and venom to call someone you don't know names for disagreeing with you. But what I'm willing to bet 1,000 dollars on is what women "friends" say behind your back. Because you're a piece of work.
